1. GENERAL PROVISIONS
1.1 These Terms and Conditions apply to all orders placed via https://simplykseniia.com/shop, operated by Kseniia [Last Name], a registered ZZP in the Netherlands (“the Seller”).
1.2 By using this website, you agree to these Terms.
1.3 The Seller may update these Terms at any time. The version active at the time of purchase applies. Changes do not apply retroactively.
2. PRODUCTS
2.1 The website offers original art, fine art prints, digital illustration prints, and related items created by the Seller.
2.2 Product descriptions are made as accurately as possible. Colors may differ slightly due to screen or print variations.
2.3 All artworks and designs are protected under copyright law. Unauthorised reproduction, commercial use, or distribution is prohibited.
2.4 International customers are responsible for any import duties, customs fees, or taxes charged in their destination country.
3.5 Any currency conversion fees, international transaction fees, or payment processing charges applied by the Buyer’s bank, card issuer, PayPal, or any other payment provider are the responsibility of the Buyer. The Seller must receive the full invoiced amount; therefore, all additional payment fees are borne by the Buyer and are not deductible from the purchase price.
3. PRICES & PAYMENTS
3.1 Prices are listed in euros (€) and include VAT where applicable. VAT may vary based on the Buyer’s location according to EU rules.
3.2 Shipping costs are displayed at checkout.
3.3 Orders are processed only after full payment through accepted payment methods.
3.4 Before opening a PayPal or bank dispute, Buyers agree to contact the Seller at hello@simplyksenii.com. Most issues can be resolved quickly without third-party intervention.
3.5 Any currency conversion fees, international transaction fees, or payment processing charges applied by the Buyer’s bank, card issuer, PayPal, or any other payment provider are the responsibility of the Buyer. 4. ORDERS & AGREEMENTS
4.1 An order is confirmed once payment is received. The Buyer will receive an email confirmation.
4.2 The Seller may cancel an order in cases of non-payment, suspected fraud, or misuse.
4.3 If the Seller cancels an order, any collected payment will be refunded in full.
5. SHIPPING & DELIVERY
5.1 Orders generally ship within 3–7 business days. Made-to-order or pre-order items may require additional production time.
5.2 International delivery times vary and may be affected by customs processing.
5.3 Delays caused by postal carriers or customs are outside the Seller’s control.
5.4 Risk of loss transfers to the Buyer upon delivery.
5.5 If an incorrect or incomplete address is provided, reshipping costs are the responsibility of the Buyer.
5.6 The Buyer must inspect the product upon delivery. Any transport damage must be reported within 48 hours to be eligible for replacement.
5.7 Pre-order or made-to-order items are subject to production timelines. Delays due to supplier availability or material shortages do not constitute grounds for cancellation or compensation.
6. RETURNS & RIGHT OF WITHDRAWAL
6.1 Most products are made to order and produced individually after purchase. Under Article 6:230p BW, such items are exempt from the statutory right of withdrawal and cannot be returned.
6.2 For any products that are not made to order (if applicable), the Buyer may withdraw within 14 days of receipt.
6.3 To withdraw, the Buyer must notify the Seller in writing within the 14-day period. Items must be returned unused and in original or equivalent protective packaging.
6.4 Return shipping costs are borne by the Buyer unless the item arrived damaged or incorrect. Refunds for eligible items (excluding upgraded shipping costs) are processed within 14 days of receiving the return.
6.5 Damage or incorrect products must be reported within 48 hours with supporting photos for a replacement or refund.
6.6 Refunds cannot be issued for delays caused by postal carriers, customs, or external disruptions.
6.7 Refunds will not be issued for misunderstandings arising from failure to read product descriptions, size information, or material specifications.
6.8 Refunds cannot be issued if a product was purchased as a gift and the recipient does not wish to keep it.
7. INTERNATIONAL CUSTOMS, FEES & REFUSED PARCELS
7.1 Orders shipped outside the EU may incur customs duties, VAT, import taxes, and handling fees. These are the responsibility of the Buyer and are not included in product or shipping prices.
7.2 If a Buyer refuses to pay customs fees, the parcel will be returned. Original shipping costs are non-refundable. If the carrier charges return shipping, these costs will be deducted from any eligible refund.
7.3 Made-to-order items are not refundable in cases of customs refusal.
8. SHIPPING LIABILITY
8.1 Once a parcel is handed to the carrier, the Seller is not liable for transit-related delays, damage, or loss.
8.2 Tracking is provided where available. Buyers are responsible for monitoring tracking and contacting carriers when necessary.
8.3 If a parcel is marked “delivered” but the Buyer claims non-receipt, the carrier’s investigation determines liability. Refunds cannot be issued unless the carrier accepts fault.
9. ARTISTIC VARIATIONS
9.1 Minor variations in color, tone, texture, cropping, or print alignment may occur due to printing processes, screen differences, paper characteristics, and production tolerances. These variations are not considered defects and are not grounds for refunds or replacements.
9.2 Fine art papers, cotton papers, and textured papers may show natural grain, fibers, or surface inconsistencies. These are inherent to the material and part of the intended artistic presentation.
9.3 Differences between the original painting and its printed reproduction — including contrast, brushstroke detail, or color intensity — are normal and do not constitute a defect.
9.4 Trimming margins may vary slightly due to manufacturing tolerances. Such variations do not affect the usability of the print and are not considered grounds for returns.
9.5 Hand-signed or hand-finished elements may contain natural inconsistencies, which are part of the artwork’s uniqueness and are not considered defects.
9.6 Damage caused by improper opening of packaging (such as cutting into the print while opening the tube or bending the artwork during unpacking) is not the responsibility of the Seller and is not eligible for a refund or replacement.
9.7 A small tolerance in final dimensions (up to 3–5 mm) may occur due to cutting and trimming processes. Such differences are not considered defects.
10. INTELLECTUAL PROPERTY RIGHTS
10.1 All artworks, product images, photographs, text, branding, designs, and any other content displayed on this website are the exclusive intellectual property of the Seller. These materials may be accessed for personal viewing only.
10.2 Purchasing an original artwork, print, postcard, or any physical product does not transfer copyright, reproduction rights, licensing rights, merchandising rights, or digital rights to the Buyer. Copyright always remains with the Seller unless explicitly transferred in writing.
10.3 The Buyer may not, without written permission from the Seller:
Copy, scan, photograph, or digitize any artwork for reproduction
Upload artwork to print-on-demand or merchandise platforms
Create derivative works or modified versions
Mint the artwork as NFTs or use it in blockchain applications
Use artwork for commercial, promotional, or editorial purposes
Train AI models, datasets, or algorithms using the Seller’s artwork
Distribute or publish artwork online or offline beyond personal sharing
10.4 Reselling a physical print is permitted only as a private, non-commercial transaction. Commercial resale, bulk resale, or resale for profit requires written permission from the Seller.
10.5 The Buyer may not reproduce, republish, or redistribute any of the Seller’s content—including art images, website product photos, descriptions, titles, or branding—for business, educational, or commercial purposes without explicit permission.
10.6 Any unauthorized use of the Seller’s intellectual property will be considered a copyright violation and may result in legal action, including claims for damages and removal requests.

15.3 Before initiating external disputes (e.g., PayPal), Buyers agree to contact the Seller directly.
15.4 Unresolved matters will be brought before the competent court in the Seller’s region.
16. FORCE MAJEURE
16.1 The Seller is not liable for failure to fulfill obligations due to circumstances beyond reasonable control, such as postal strikes, customs delays, natural disasters, or transportation disruptions.
16.2 Obligations are extended automatically during such events.
17. INCORRECT OR INCOMPLETE ADDRESSES
17.1 The Buyer must provide a complete and accurate shipping address.
17.2 Orders returned due to incorrect addresses may incur additional reshipping costs. Refunds will not be issued for undeliverable orders caused by Buyer error.
